These Terms of Service ("Terms") govern your use of the services provided by OMM TECHNOLOGY ("we," "us," or "our"), a web development and digital solutions company. By engaging with our services, including website development, e-commerce solutions, UI/UX design, SEO, and maintenance, you ("you" or "Client") agree to these Terms.

We reserve the right to update these Terms at any time. Continued use of our services after changes constitutes acceptance of the revised Terms.

We provide custom web development, e-commerce platforms, web applications, UI/UX design, SEO & digital marketing, and maintenance services as outlined on our website. All services are provided on a project basis or as ongoing support, with specifics detailed in individual project agreements or proposals.

• Services are delivered remotely unless otherwise specified.
• We aim for high-quality deliverables but cannot guarantee specific outcomes like search rankings or sales conversions.
• Any timelines provided are estimates and subject to change based on client feedback and unforeseen circumstances.

As a Client, you agree to:

• Provide accurate, complete, and timely information, including content, assets, and feedback.
• Ensure all provided materials do not infringe on third-party rights (e.g., copyrights, trademarks).
• Respond to requests within agreed timelines to avoid project delays.
• Handle any necessary third-party approvals, such as domain registration or hosting setup.
• Not use our services for illegal, harmful, or unethical purposes.

Upon full payment, we grant you a non-exclusive, perpetual license to use the deliverables for your business purposes. We retain ownership of all source code, designs, and methodologies unless explicitly transferred in writing.

• You retain ownership of any pre-existing materials you provide.
• We may use anonymized project details in our portfolio with your consent.
• Any third-party tools or libraries used are subject to their respective licenses.
• Infringement claims arising from your materials are your sole responsibility.

Payments are due as per the project agreement (e.g., 50% upfront, balance on completion). All fees are in Indian Rupees (₹) and non-refundable except as specified.

• Late payments incur a 1.5% monthly interest.
• Additional work beyond the scope requires a change order and extra fees.
• We accept payments via bank transfer, UPI, or other agreed methods.
• Projects may be paused or terminated for non-payment after 30 days.

Either party may terminate services with 30 days' written notice. Immediate termination is possible for material breaches (e.g., non-payment, misuse).

• Upon termination, you must pay for all work completed to date.
• We will deliver any completed deliverables upon settlement of outstanding fees.
• Ongoing maintenance services follow a 7-day notice period.

Our liability is limited to the total fees paid for the project. We are not liable for indirect, consequential, or incidental damages, including lost profits or data loss.

• We do not guarantee uninterrupted or error-free service.
• You agree to indemnify us against third-party claims arising from your use of our services.
• We are not responsible for issues arising from third-party services or tools.

These Terms are governed by the laws of India. Any disputes will be resolved in the courts of Bhubaneswar, Odisha.
